Court: Bias has a price for Scouts *headline c/o the Sacramento Bee I guess "I'd told you so" didn't cut it. When I was fighting my case from 1992-1998, the issue of losing public funds for discriminatory practices was on the back burner, but the answer from the scouts was always along the lines of "We have a national charter, and public support what do we have to worry about." Well the CA Supreme Court told the scouts that they could no longer be a private organization with public benefits. I personally thought the CA Supreme Court decided to carve a special "boy scouts" exemption to the Unruh Act for the Scouts. But the decision in Curran (of which my case was folded into) planted the seeds which have bloomed into the recent decision of Evans v. City of Berkeley. Not to mention a Connecticut case that held it was legal for the state of Connecticut to withhold Public funds from the Scouts since they did not adhere to the requirements set by the state government. essentially, the decision comes down to this, "If you want public money or access to public property, you better be able and willing to follow the standards as set by a municipal government."
